Know Your Options to Stop Foreclosure

In defending a home from foreclosure, the homeowner must research first on various legal defense options. Although, most of those defenses to stop foreclosure may be used in answer of the complaint but a few of those defenses should be looked upon to determine if filling a Motion to Dismiss is suitable.

Even though this stop foreclosure program can be time consuming, the homeowner must be prepared to give hours of research into how various laws work, what could point an offense and how it would affect the bank’s dispute. The use of a defense to stop foreclosures depends on what the goal of the homeowner is. That is if the homeowner intends to keep the foreclosed homes, have a mortgage modification by the bank, or just get as much time and sell the house or move out.

If the homeowner is trying to have its mortgage totally revoke, borrowers should not raise their defenses with a maximum penalty to the bank with having a few thousand dollars. They should find a severe law with heavier penalties. Trying to stop a foreclosure by defending the suit should give special consideration to their defenses that would let the whole mortgage revoked or the suit thrown out of court.

The homeowner must also have an objective to file a Motion to dismiss the lawsuit establishing that the bank’s lack of legal standing or failing to proceed with the notification and pre-foreclosure procedures before beginning the lawsuit. If the lender does not take this into consideration, the lawsuit may be given up for the meantime until the bank follows the prerequisite.

Those homeowners who are facing foreclosure automatically file a Motion for Extension of Time. The advantage of this is relevant to almost all borrowers, together with those who want extra more time for their defense, work for stop foreclosure option with the lender, or just buy them some time before moving out. But if a homeowner is serious in guarding their home, the next solution is to search what laws and regulations apply to their case.
